DISCLAIMER:  Seller (XZILR8ING MOTOR SPORTS) makes no warranties as to merchantability or fitness for a particular purpose; either expresses or implied, and disclaims any responsibility for the product when used not as intended or by inappropriate users.  On Carter Brother off-road go-karts, there is a 6 month warranty on the frames and a limited 2-year warranty on their motors.  Our SYM scooters also come with a 2 year warranty for both parts & labor.  Plastic parts and commonly worn parts, brakes, spark plugs, tires, tubes, air filters, batteries, and ignition switches are not covered under warranty.  Any excessive wear, abuse, modified parts, or parts used outside of documented specification will void any warranty.  Seller reserves the right to determine excessive wear.

PURCHASER’S RESPONSIBILITY:  You must inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and is safe to use.  You further understand that you are responsible for damage to equipment.  Purchaser understands that the nature of motor scooter riding and motorcycle related activities and acknowledges that he or she is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity.  Purchaser agrees to assume all risks when allowing others to operate purchaser’s scooter.  If purchaser is not familiar with the nature of motor scooter riding, purchaser should seek professional training before operating a scooter.

Purchaser further understands that their product is not be used in competitive sports, modified, rented, or used for jumping, stunts or similar activity.

A written manual is included with your scooter, it is your inherent responsibility to read it completely to avoid injuring yourself and others.  You must pay particular attention to the "Maintenance Schedule" listed in the back of your Owner's Manual.  You MUST take care of it if you expect it to last for many years to come.  Review all the safety instructions carefully before operation.

Do not allow others to use your scooter without proper instructions.  Remember to always operate your scooter with the proper safety gear and helmet.  The scooter is intended for operation on public streets and roads.  ATV''s, go-karts, and pit bikes are NOT intended for use on public streets and roads.  They are not to be driven without proper licensure.   Motor Scooters over 50cc require that you have a “Motorcycle Endorsement” on your driver’s license.  50cc or less do not require this endorsement; however, you must have your driver’s license.  You must be over 18 years of age to sign this Disclaimer in our shop.

INHERENT RISKS:  Warning!  Scooters, ATV''s, go-karts, and pit bike riding activities involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death.  These inherent risks and dangers may be caused by purchaser’s own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others.  There may be additional risks, including social and economic loss, either known or unknown to purchaser, not readily foreseeable, and purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of purchaser participation in scooter riding activity.

OPERATION, REGISTRATION AND LICENSE:  We take care of all of the registration paperwork for you here at our offices.  Purchaser is responsible for operating the motor scooter in accordance with local and state laws and ordinances.  Seller makes no representations that the motor scooter is legal for operation in your City and State.

XZILR8ING MOTOR SPORTS will NOT be liable for any injuries to rider or scooter.

Your insurance policies may not provide coverage for accidents involving the use of this scooter.  To determine if coverage is provided, you should contact your insurance company or agent.
